These Terms and Conditions regulate the download, access, and use of the mobile application MindFood (hereinafter, the “APP”), which Apparent Group Limited owns and makes available to users on Google Play (Android) and Apple Store (iOS).

The user acquires this condition by downloading and using the APP. By accessing the APP, the user acknowledges having accepted and consented unreservedly to these terms of use and privacy policy.

1. RESPONSIBLE FOR THE APP

Apparent Group Limited, Company Registration number 73428962, (hereinafter “MindFood” or “we”), with registered office at FLAT/RM 0 5 – 0 6 HOLLYWOOD PLAZA, 6 1 0 NATHAN ROAD, 1 8 / F, KL, Hong Kong and email: hello@apparentgroup.co is the owner and responsible for the APP.

2. OBJECT

The APP has been developed as a micro-learning and personal development platform. Its purpose is to provide users with condensed knowledge from various sources—including non-fiction book summaries, video-based mini-courses, and podcasts—designed for easy and efficient consumption to help build a consistent learning habit.

3. COMPATIBLE DEVICES

The APP is available on Google Play (Android) and the Apple App Store (iOS). The user acknowledges and agrees to comply with all applicable terms and conditions of the respective application store regarding obtaining, downloading, and updating the APP.

4. GETTING STARTED

Upon starting the APP, the user can begin exploring content. To access the full range of features, including saving to a personal library and tracking progress, the user must create an account.

The APP operates on a freemium model. Users can access a limited selection of content and features for free. To unlock the entire library of book summaries, courses, and other premium features, the user must subscribe to the Premium version. Payments are processed through the payment options offered by the Google Play Store or Apple App Store.

5. METHOD OF USE

The APP is structured around several key features designed to provide a comprehensive and engaging learning experience:

  • Home & Discovery: A personalized dashboard where users can discover new content through recommendations (“Top Picks for you”), continue their last session, and browse categories.
  • Book Summaries: Key insights from non-fiction books available in both text (“Read”) and audio (“Play”) formats, with customizable reading and listening experiences.
  • Courses (“Elevate”): A dedicated section for structured, video-based mini-courses on topics like self-improvement and business.
  • Podcasts (“Listen”): A curated selection of podcasts for on-the-go learning.1
  • Library: A personal space where users can save and organize their favorite book summaries, courses, and other content, filtered by status (“Not Started,” “In Progress,” “Finished”).
  • Reading Challenges: Gamified challenges that encourage users to complete a certain amount of reading over a set period to build consistency.
  • Profile & Progress Tracking: Users can set daily learning goals, monitor their progress, and track their learning streaks to stay motivated.

6. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The intellectual and industrial property rights over the APP and all its content (including but not limited to book summaries, course videos, audio files, and text) are owned by or licensed to Apparent Group Limited. The user acknowledges that the reproduction, modification, distribution, or decompilation of any of the elements and utilities integrated within the development constitutes an infringement of these intellectual property rights.

Users may not create derivative works from the content provided in the APP. The license granted to users is for personal, non-commercial use only.

7. PRIVACY POLICY

In compliance with applicable regulations on personal data protection, we inform you that personal data provided by our users will be processed by Apparent Group Limited as Data Controller.

7.1 What personal data do we process?

We process data you provide to us and data we collect automatically to personalize and improve your learning journey.

  1. A) Data You Provide Directly:
  • Account Information: Name, email address, and password to create and manage your account.
  • User Preferences: Information you provide such as daily learning goals, language preferences, and categories of interest.
  1. B) Data We Collect Automatically:
  • Usage and Progress Data: Information about your activity on the APP, including which book summaries you read or listen to, which courses you watch, your progress percentage, your challenge participation and completion, and your learning streaks. This data is essential for providing personalized recommendations and tracking your progress.
  • Library Data: Information about the content you save to your personal library.
  • Log and Device Data: Information about your mobile device, including device identifier, model, operating system, and IP address, as well as information on app performance like crash reports.
  • Push Notifications: We may request to send you push notifications to remind you of your goals or suggest new content. You can disable these in your device settings.

7.2 Purposes and Legal Basis for Processing

Your personal data will be processed for the following purposes:

  • To Provide and Personalize Our Services: To create and maintain your account, deliver content, track your learning progress, and provide personalized recommendations based on your usage history. The legal basis is the performance of the contract between you and MindFood.
  • For Analytics and Service Improvement: To understand how users interact with the APP in order to enhance the user experience, develop new features, and optimize content delivery. The legal basis is our legitimate interest in improving our services.
  • To Communicate With You: To send you service-related notifications, progress updates, and support messages. The legal basis is the performance of the contract.
  • For Marketing and Promotions: To send you information about new features, content, and promotions, with your explicit consent.

7.3 To whom do we provide your personal data?

We only share your data with third-party service providers who are strictly necessary to operate our APP. These include:

  • Cloud Storage and Backend Services: For secure data storage of your account and progress data (e.g., Amazon Web Services, Google Cloud).
  • Analytics Services: To help us understand app usage (e.g., Google Analytics, Mixpanel).
  • Payment Processors: To handle subscriptions (i.e., Apple and Google).

7.4 Minors

The APP is intended for users who are at least 13 years of age. We do not knowingly collect personal information from children under 13. If you are between 13 and 18, you may use the app only with the involvement and consent of a parent or guardian.

7.5 International Transfers

Our company is registered in Hong Kong. We use global third-party service providers that may be based in other countries. By using our APP, you acknowledge that your personal data may be transferred to, stored, and processed in countries outside of your residence. We take appropriate measures to ensure your data is protected.

7.6 Exercise of Your Rights

You have the right to access, rectify, delete, or request the portability of your personal data. To exercise these rights, please send a written communication to hello@apparentgroup.co.

7.7 Security

We implement appropriate technical and organizational security measures to protect your personal data from alteration, loss, or unauthorized access.

7.8 Changes to the Privacy Policy

We may update this Privacy Policy from time to time. The updated version will always be available in the APP.

8. RESPONSIBILITY & DISCLAIMER

MindFood provides content for informational, educational, and entertainment purposes only. The summaries, courses, and podcasts are interpretations of original works and are not intended to be a substitute for reading the original books or for professional advice.

The content within the APP, especially in categories like finance, career, or psychology, does not constitute professional advice. Always seek the advice of a qualified professional with any questions you may have. MindFood is not liable for any decisions or actions taken by the user based on the content provided.

9. NULLITY AND INEFFECTIVENESS OF THE CLAUSES

If any clause included in these Terms and Conditions is declared totally or partially null and void, such nullity shall only affect that provision, and the rest of the Terms and Conditions shall remain in force.

10. APPLICABLE LAW AND JURISDICTION

These terms will be governed by the laws of the Hong Kong Special Administrative Region. Both parties submit to the exclusive jurisdiction of the courts of Hong Kong.
